Title
Consider An Ordinance Amending Title IX, Chapter 95 Of The Carrollton Code Of Ordinances - “Weeds And Other Unsanitary Matter” To Regulate Vegetation Nuisances.
Body
BACKGROUND:
This item proposes an ordinance amendment to align Chapter 95 “Weeds and Other Unsanitary Matter” of the Carrollton Code of Ordinances with updates to the Texas Agriculture Code, Title 8, Chapter 251, which became effective on September 1, 2023. These amendments include updates to the definitions and nuisance vegetation height limits for agricultural operations in the City.
Recent State regulatory amendments differentiated mowing maintenance requirements for agricultural operations near certain residential and commercial properties or public improvements.
Key provisions of the revised ordinance include:
§ Updated definitions to include agricultural operations;
§ Updated vegetation height limitations and mowing setback requirements for agricultural operations per State requirements.
IMPACT ON COMMUNITY SUSTAINABILITY:
The regulation of weeds and vegetation maintenance is a basic component of a sustainable community by protecting the public health and safety. The enforcement of minimum maintenance standards reduces the hazards of high vegetation and line-of-sight nuisances endured by adjacent property owners while ensuring compliance with State requirements.
STAFF RECOMMENDATION/ACTION DESIRED:
Staff recommends that City Council adopt proposed amendments to the Carrollton Code of Ordinances, Title IX, Chapter 95 to regulate weeds and other unsanitary matter.
