Body

BACKGROUND:

This is a request for approval of a Special Use Permit (SUP) to allow a short-term rental (STR) on a single-family residential property located at 2706 Brookshire Drive.

Public comments were received.

STAFF RECOMMENDATION/ACTION DESIRED:

On January 2, 2025, the Planning and Zoning Commission recommended APPROVAL of the request. However, staff received written protest on the rezoning request, signed by the owners of 20 percent or more of the area of the land immediately adjoining the subject property and extending 200 feet therefrom. Therefore, the rezoning request shall not become effective except by the favorable vote of three-fourths (3/4) of all members of the City Council (i.e., a minimum of 6 votes needed in support).

On January 27, 2025, the applicant requested a continuance to the March 4, 2025, City Council meeting as he is unavailable to attend the meeting. Attached is the applicant’s continuance request.

Staff recommends opening the public hearing to hear any public comments, and then keep the public hearing open and CONTINUE the case to the March 4, 2025, City Council meeting.   However, should the City Council decide to take final action on the Special Use Permit to allow a short-term rental, staff recommends approval with stipulations.

The attached ordinance reflects the action of the Commission.
