Hold A Public Hearing To Consider An Ordinance Amending The Zoning To Establish A Special Use Permit To Allow Short-Term Rental On An Approximately 0.25-Acre Lot Zoned (SF-8.4/16) Single-Family Residential District And Located At 1103 Pawnee Court; Amending The Official Zoning Map Accordingly. Case No. PLSUP 2024-179 1103 Pawnee Court Short-Term Rental.

Body

BACKGROUND:

This is a request for approval of a Special Use Permit (SUP) to allow a short-term rental (STR) on a single-family residential property located at 1103 Pawnee Court.

STAFF RECOMMENDATION/ACTION DESIRED:

On January 2, 2025, the Planning and Zoning Commission recommended DENIAL of the request. The applicant submitted a written request to appeal the Commission’s decision and requested the case be scheduled for the February 4, 2025, City Council meeting.

In addition, staff received written protest against the rezoning request, signed by the owners of 20 percent or more of the area of the land immediately adjoining the subject property and extending 200 feet therefrom. Therefore, since Planning and Zoning Commission recommended denial and due to the proportion of properties in the notice area providing written opposition to the Special Use Permit, the rezoning request shall not become effective except by the favorable vote of three-fourths (3/4) of all members of the City Council (a minimum of 6 votes needed in support).

Staff originally recommended approving the SUP request.  However, there have been violations on the property since the January Planning and Zoning Commission meeting.  Therefore, staff is recommending DENIAL of the SUP request.

Should the City Council approve the SUP, staff recommends approval with the stipulations contained in the Results Sheet and adoption of the proposed ordinance.
