Title

Consider A Resolution Authorizing The City Manager To Negotiate And Execute A Developer Participation Agreement With The NRP Group, LLC For Construction Of A Portion Of Broadway South Of Jackson Road In An Amount Not To Exceed $897,110.00.

Body

BACKGROUND:

On April 2, 2024, City Council approved a resolution amending the City’s Transportation Plan to change the roadway designation of Broadway between Jackson Road and Whitlock Lane from a four-lane undivided collector street (C4U) to a three-lane special design collector street (C3SD). City Council also approved a zoning change on a 17.4-acre tract located at the southeast corner of IH-35E and Jackson Road from the (FWY) Freeway District to a planned development district allowing multi-family uses. As part of the project, the developer (NRP Group) is required to reconstruct a portion of Broadway adjacent to its property. Since the east side of Broadway abuts DART right-of-way and is currently undevelopable, the remaining portion of Broadway will not be reconstructed as part of any future development. To avoid a piecemeal reconstruction of Broadway, staff recommends that reconstructing the entirety of Broadway as part of the multi-family project is in the best interest of the City as it would provide for a full-width reconstruction of the street.

The section of Broadway to be reconstructed begins at the intersection of Broadway and Jackson Road and extends south for a length of approximately 900 linear feet. The City’s request of the project includes reconstruction of the entirety of the street and installation of streetlights and additional stormwater facilities. The total cost of the City’s portion of the reconstruction project is $897,110.00.

The purpose of this agenda item is to authorize the City Manager to negotiate and execute a Developer Participation Agreement with NRP, which will provide a roadmap for the planning and construction of Broadway as future development in the corridor occurs. This proposal was presented to, and unanimously approved by, the City Council TOD Committee on May 13, 2024.

Pursuant to state law, the City may, by contract, participate with and reimburse the developer for its expenses related to the public improvements that the developer is not otherwise required to construct, including costs related to oversizing infrastructure that exceed the project’s impact. The City’s participation cannot exceed thirty percent (30%) of the total project cost. The developer has stated that the project cost, including structures and public improvements, will exceed $94 million, which makes the City’s participation less than 30% of the total cost.

FINANCIAL IMPLICATIONS:

Funding is available in the Streets Fund.

IMPACT ON COMMUNITY SUSTAINABILITY:

This agreement will help support the City Council’s strategic objectives and vision of building a community that families and businesses want to call home by:

  • Sustaining quality of life - This project will allow the City to complete reconstruction of a segment of Broadway in a more efficient and effective manner.
  • Sustaining day-to-day operations - This project will allow the City to provide a safe and adequate roadway for vehicular traffic.

STAFF RECOMMENDATION/ACTION DESIRED:

Staff recommends City Council approval of a resolution authorizing the City Manager to enter into a Developer Participation Agreement with the NRP Group for construction of a portion of Broadway in an amount not to exceed $897,110.00.
