Summary:
The purpose of this item is to obtain ownership of property needed to accommodate the Oak Creek Tennis Center parking lot expansion.
Background:
Proposition C of the 2022 Bond Election provided for improvements at the Oak Creek Tennis Center, which was originally built in 2001. The project scope includes the construction of additional tennis courts, new pickleball courts, renovation of the pro shop building, expansion of the parking lot, and other site amenities. The improvements are intended to serve the continued needs of the community and further promote the physical well-being of Carrollton citizens.
The proposed parking lot expansion encroaches onto a separate property, 3950 Marsh Lane, currently held in trust by the City of Carrollton, Denton County, and Lewisville ISD (LISD). The City would like to request the trust be disbanded and the property be transferred to the City by Denton County and Lewisville ISD. As the trust does not have any funds, the City’s right-of-way consultant, Teague, Nall, and Perkins, Inc., has recommended the City execute a request for waiver of compensation from Denton County.
Staff and the consultant have been in contact with Denton County and LISD and believe they are agreeable to the proposition and purpose. While a formal request is required for Denton County to place this item on the Commissioner’s Court agenda, LISD has not provided a requirement for a similar letter of request.
Financial Implications:
Teague, Nall, and Perkins, Inc., has submitted the requisite documents to the City of Carrollton to execute the request. There are no costs associated with this request.

Staff recommends adopting a resolution authorizing the Mayor to execute a request for waiver of compensation from Denton County for the acquisition of property held in trust between the City of Carrollton, Denton County, and Lewisville ISD relating to the Oak Creek Tennis Center (OCTC) improvements project.
