BACKGROUND:

This is a request for approval of a Special Use Permit (SUP) to allow a short-term rental (STR) on a single-family detached residential property located at 2017 Sam Houston Boulevard.

 

Public comments were received, mostly in opposition to the request. Staff calculated the percentage of land in opposition, in accordance with state statutes. The total percentage of land in opposition is 21.88 percent.

 

STAFF RECOMMENDATION/ACTION DESIRED:

On March 6, 2025, the Planning and Zoning Commission recommended DENIAL of the request. The applicant submitted a written request to appeal the Commission’s decision and requested the case be scheduled for the April 1, 2025, City Council meeting.  A three-fourths (3/4) affirmative vote by all members of the City Council is required to overrule the Commission’s recommendation of denial.

 

Staff is recommending approval of the SUP request. Should the City Council approve the SUP, the attached ordinance provides staff’s recommended stipulations for Council’s consideration.
