BACKGROUND:
Staff has received a recommendation from the Denton County Tax Assessor of a waiver of penalty and interest on behalf of David and Julie Martinez (Account #162563DEN).  
 
The property was purchased on September 25, 2012.  The property owner was updated in the Appraisal District records for the 2013 year however a Name and Address Change was not submitted for the 2012 Tax Year.
 
As a result, the property owner did not receive a tax bill and subsequently was unaware that taxes were due.  The property owner is now aware of the taxes that are due and has made payment for the original base tax. 
 
The State of Texas Tax Code Section 33.011 provides for a waiver of penalty and/or interest by a governing body of the taxing unit under certain circumstances.  It is very rare for the Tax Assessor Collector to encounter a truly valid request and make a recommendation for a waiver.  The governing body must approve the waiver.
 
FINANCIAL IMPLICATIONS:
Total amount of penalty and interest to be waiver will be $128.66.

Approval of the attached resolution.
