BACKGROUND:
On January 6, 2015, the City Council authorized the purchase of 1309 South Broadway in Historic Downtown Carrollton. Located at the northeast corner of Broadway and Vandergriff, the parcel was used as an automobile repair facility and was considerably blighted.

On October 13, 2015, the City Council approved an agreement with Monkey King Noodle Company (MKNC III, LLC) to lease 7,668 square feet of the property for a restaurant. Under the terms of the lease, MKNC is permitted to sublet the property and the landlord (being the City) is permitted to assign rights granted under the lease. After the City Council expressed interest in subletting a portion of the property, staff began working with MKNC to find an additional tenant that would add value to the property and without competing against MKNC.

The attached resolution will approve a lease agreement with CTC Carrollton, LLC d/b/a Cow Tipping Creamery to operate a free-standing Cow Tipping Creamery food truck at 1309 South Broadway. The lease is for an initial 6-month term in which Cow Tipping Creamery would remit $450.00 per month to the City as well as a monthly stipend of $150.00 to MKNC for the use of their restrooms and seating space. The lease can be extended for three (3) successive six (6) month periods.

The food truck will be positioned on a concrete slab poured on the eastern side of the property, closer to Vandergriff. Per the City's food truck ordinance, the truck will remain on-site except for regular trips to a food truck commissary for cleaning.
