Consider An Ordinance Relating to Continuation of A Local State Of Disaster, Including Providing For Additional Authority, Rules, And Procedures Related To Containment Measures And A Penalty For Non-Compliance.

BACKGROUND:

The City Council adopted Resolution No 4373 on March 19, 2020, consenting to and continuing the Local Declaration of Disaster Issued by Mayor Kevin Falconer.  There have been numerous updates by the three counties that are a part of Carrollton and Governor Greg Abbott issued new order on March 31, 2020, that expanded some of the guidelines from his original proclamation.

 

In order to provide consistency within the entire city, as opposed to the current situation with two separate county orders and a governor’s proclamation, that all vary, the proposed ordinance would establish set regulations that apply in all three counties and also establish a lower level offense than that provided in the county orders and proclamation.  This ordinance would also provide authority for the City’s code officers to take enforcement action.

 

STAFF RECOMMENDATION/ACTION DESIRED:

Staff recommends approval of the attached ordinance relating to the Continuation of the Local Disaster Declaration, with additional guidelines regarding allowable actions and restrictions necessary to ensure containment, and applicable penalty.
