BACKGROUND:
This agenda item introduces a new chapter to the City's Code of Ordinances-Chapter 100 - Temporary Short-Term Rental and Bed and Breakfast Permit During Interim Prohibition-to supplement existing regulations governing short-term rental (STR) and bed and breakfast (B&B) properties. This ordinance builds upon Ordinance No. 4127, adopted on February 7, 2023, which granted non-conforming status to eligible STR and B&B operations in existence prior to Feb. 7, 2023, and established a special use permit (SUP) process for all new temporary housing uses.

In response to ongoing concerns regarding the impact of STRs and B&Bs on neighborhood stability and public safety, the City Council has considered and approved a one-year interim prohibition on the application and issuance of an SUP for STR and B&B uses (STR/B&B-SUP). During this period, the City would suspend new STR/B&B-SUP applications to allow time for further study and policy development. To support continued regulation of STR and B&B operations that were active prior to the proposed prohibition, but did not receive non-conforming status, Chapter 100 would establish a temporary permitting option subject to eligibility, enforcement, and revocation provisions. o The owner, operator, or property manager is not a registered sex offender;
